Is DHS being given a free pass by the courts?
Can someone tell me what's going on with DHS? The latest from Politico has me lost - Mullin refuses to commit to following court orders. He said he'd answer the question "if we didn’t think courts were politicized." That kinda sounds like dodging responsibility to me.

I've been following the news on this for a bit and it feels like the administration is getting too caught up in its own narrative to care about doing the right thing. It's hard for me to understand how someone can claim to be working for the country and then so blatantly disregard its institutions.

What's going on here? Is there some context I'm missing? Do people really think the DHS should be allowed to pick and choose which court orders it follows?

Finally posting after lurking for what feels like an eternity, immigration detention mostly. all the other stuff seems like low-hanging fruit in comparison. but don't quote me, i'm still trying to wrap my head around it

Man I've been following this stuff for years, but it's just now hitting me in a real way - my cousin was detained in the border last year and the trauma it left on our whole family was...something I think I'm still processing, but yeah, it feels like we're not giving DHS enough scrutiny

I feel you Juan, and thanks for finally posting, but I have to respectfully disagree that it's that simple - the courts have been holding DHS accountable on certain aspects, but there are areas where they clearly haven't

I was actually in a courthouse for a friend's deportation hearing last year, and what stuck with me was the judge just rubber-stamping DHS's reasoning without even questioning it - I think that's what we're getting at here.

We're comparing immigration detention cases like Zadvydas v. Davis where DHS got courts to interpret a 1-year limit as effectively indefinite, and also the Migrant Protection Protocols cases where courts kept letting them continue.

i'm so fed up with this administration being let off the hook time and time again. It feels like no matter how many times they're caught stepping over the line, the courts always manage to sweep it under the rug - it's infuriating to watch from the outside.

I can see why you'd feel that way, the notion that the courts are giving DHS a free pass can be infuriating, it's like, we're not getting any answers, any real accountability is just being pushed under the rug. It feels like the system is working to protect itself, not serve justice.

I've been following some of the court cases and it seems LIKE DHS is getting pretty lenient treatment, especially with regards to their immigration policies. Are you suggesting that the courts are going easier on DHS because of their argument that it's all about national security or is something else at play?

I'm so frustrated with the trend where DHS seems to be skating by with their questionable decisions in court, it reminds me of the Border Patrol's use of "reasonable suspicion" to detain migrants, which has been repeatedly deemed overly broad and unconstitutional. When will our courts start holding them accountable on a bigger scale?
